Basic rules and conditions for renting our vehicles

Chapter 1: General Provisions

Article 1 (Application of Terms)

  1. The Company shall rent a vehicle (hereinafter referred to as the "Rental Car") to the Renter in accordance with the provisions of these Terms and Conditions, and the Renter shall rent it. Matters not prescribed in these Terms and Conditions shall be handled in accordance with laws, regulations, and general customs.
  2. The Company may accept special agreements provided they do not conflict with the purpose of these Terms and Conditions, laws, administrative notices, and general customs. In the event a special agreement is made, it shall supersede these Terms and Conditions.

Article 2 (Definitions)

  1. "Renter" refers to the person who rents the Rental Car from the Company.
  2. "Driver" refers to the person who drives the Rental Car.
  3. "Rental Certificate" refers to the document created when renting the Rental Car.

Chapter 2: Reservations

Article 3 (Making a Reservation)

  1. When renting a Rental Car, the Renter may make a reservation by agreeing to the pricing listed and specifying the vehicle class, start date/time, rental location, rental period, return location, driver, necessary accessories (like child seats), and other rental conditions in advance.
  2. Upon receiving a reservation request, the Company shall, in principle, fulfill the reservation within the scope of its available Rental Cars. In such cases, the Renter may be required to pay a designated reservation deposit.

Article 4 (Changing a Reservation)

If the Renter wishes to change the rental conditions described in the preceding article, they must obtain the Company's consent in advance.

Article 5 (Cancellation of Reservation, etc.)

  1. The Renter may cancel the reservation with the Company's consent.
  2. If the Renter fails to begin the procedures for the Rental Agreement within 1 hour after the reserved rental start time due to their own circumstances, the reservation shall be deemed cancelled.
  3. In the cases of the preceding two paragraphs, the Renter shall pay the Company a cancellation fee as defined separately. Upon payment, the Company shall return any received reservation deposit.
  4. If the reservation is cancelled or the Rental Agreement is not concluded due to the Company's circumstances, the Company shall return any received reservation deposit and pay a designated penalty fee.
  5. If the Rental Agreement is not concluded due to accidents, theft, non-returns, recalls, natural disasters, or any other reasons not attributable to either the Renter or the Company, the reservation shall be deemed cancelled, and the deposit returned.

Article 6 (Substitute Rental Cars)

In the event the Company cannot provide a Rental Car of the requested class, it may offer a substitute vehicle of a different class. If the Renter accepts, the pricing shall reflect the lower of the two classes.

Chapter 3: Rental Agreement

Article 9 (Conclusion of the Rental Agreement)

  1. The Rental Agreement shall be concluded when the Renter pays the rental fee and the Company hands over the Rental Car. The Company will require the presentation and a copy of the Driver's valid driving license and passport/ID.
  2. The Company may specify payment methods such as credit card or cash at the time of contract execution.

Article 10 (Refusal to Conclude the Rental Agreement)

The Company may refuse to rent the vehicle if the driver cannot provide a valid license, is visibly intoxicated, attempts to transport an infant without a child seat, or belongs to an antisocial force/organized crime group.

Article 12 (Rental Fees)

Rental fees include the Basic Fee, Collision Damage Waiver, Special Equipment Fee, Fuel Fee, Delivery/Collection Fee, and other designated fees.

Chapter 4: Use of the Vehicle

Article 16 (Management Responsibility)

During the rental period, the Renter/Driver shall use and store the Rental Car with the care of a good manager.

Article 18 (Prohibited Acts)

The Renter/Driver must not use the Rental Car for unauthorized transport businesses, sublet the vehicle, alter/modify the vehicle, use it in races or for towing, or take the vehicle outside of Japan without permission.

Article 19 (Measures for Illegal Parking)

If the Renter/Driver commits illegal parking, they must directly report to the local police station and pay the fine. Failure to do so will result in the Company charging designated penalty and towing fees to the Renter, and reporting the Renter to the national rental car association system.

Chapter 5: Return of the Vehicle

Article 20 (Return Responsibility)

The Renter must return the Rental Car to the specified location before the agreement expires. Failure to do so requires the Renter to compensate for any resulting damages.

Article 24 (Measures for Non-Return)

If the Renter fails to return the vehicle and cannot be contacted, the Company will take legal actions including filing a criminal complaint and tracking the vehicle's location.

Chapter 6: Breakdowns, Accidents, and Theft

Article 25-27 (Procedures)

In the event of a breakdown, the Renter must stop driving immediately and contact the Company. In the event of an accident or theft, the Renter must stop immediately, secure safety, report to the police (Call 110), and then notify the Company and its insurance provider.

Chapter 7: Compensation and Insurance

Article 29 (Compensation and Non-Operation Charge)

The Renter is liable to compensate the Company for any damages, including paying a Non-Operation Charge (NOC) if the vehicle requires repair or cleaning due to accidents or misuse.

Article 30 (Insurance System)

Provided the Renter acts within the law and these Terms, they are covered under the Company’s basic insurance (Bodily Injury: Unlimited, Property Damage: Unlimited with deductible, Vehicle Damage: Market value with deductible, Personal Injury: up to 30 million JPY). Accidents unnotified to the Police/Company or resulting from prohibited acts will void all coverage.

Chapter 8: Termination

The Company may terminate the Rental Agreement immediately without notice if the Renter violates these Terms.

Chapter 9: Miscellaneous

These Terms shall be interpreted in accordance with the laws of Japan. Any disputes will fall under the exclusive jurisdiction of the court governing the location of the Company's headquarters.

Supplementary Provisions
These terms went into effect on July 1, 2020.
